Why Mediation

Mediation is suitable to resolve real issues in your workplace or for various family law cases, such as divorce, custody, child support, and any situation where a conflict needs resolving. In addition, mediation is effective in most non-criminal cases.

In mediation, a neutral third party will assist you in discovering and resolving real issues between Parties. A qualified Mediator will allow all Parties to talk with each other and hear each other’s points of view. 

The Mediator will ensure all parties can talk things through, with the aim to see if all Parties can come up with reaching agreed solutions. Even in the end, if the Parties do not resolve the dispute, in most cases, mediation will “bring out” the real issues, enhancing communications between all Parties and fostering an improved relationship.

Mediation costs far less and ensures the dispute resolves in an orderly manner where the Mediator will ensure that ground rules apply. 

The Mediator’s commitment to confidentiality is vital, and all information shared during the Mediation process is confidential and protected – therefore, all Parties have the freedom to discuss issues without fearing that what was said could be used against them later. However, an exception to confidentially is when Parties want to disclose information regarding a crime or an issue of public safety.

Mediation is unsuitable where there is a current fear, or high risk of violence, alcohol or drug abuse, mental illness, physical or psychological abuse, cases in which one party has an order of protection against the other, bad faith bargaining, an unwillingness to negotiate, a lack of any negotiation power, an incapacity to negotiate, duress, overriding public interest.
